The following terms and conditions are applicable to all vacation packages.
PAYMENTS AND DOCUMENTS
- Full payment is due at time of booking via credit card only.
- All online bookings must be made at least five (5) days prior to departure
- Listed prices are subject to change for events beyond the control of Southwest Airlines Vacations including, but not limited to, increases in fuel or establishment of surcharges, departure taxes, tariffs, or passenger facility charges. No price change will apply to any package once it has been paid in full; however, Southwest Airlines Vacations reserves the right to reinvoice your package should an error be made in computing your package price.
- If a booking is made 14 days or less prior to departure date, a $7.50 document delivery fee will be charged and documents will automatically be delivered via a two (2) day express mail service.
- The address to which travel documents will be delivered must match the credit card billing address. Travel documents are typically printed and mailed, express or otherwise, approximately 21 days prior to departure. If travel is booked inside of 21 days, documents will be printed and mailed within approximately 48 hours.
- Items not included in the package price consist of, but are not limited to, baggage handling, tips and gratuities, meals, rollaway beds, cribs, and all items of a strictly personal nature. These items are the sole responsibility of the Customer and should be paid directly when the service is received.
- Hotel Taxes and Service Fees: Southwest Airlines Vacations markets hotels under a “prepaid/merchant” model, where we collect the full amount from the Customer in advance and manage the payments to the hotel on their behalf. In connection with facilitating hotel arrangements, the amount Customers are charged will include taxes and service fees. This amount includes an estimate to recover the amount paid to the hotel related to their reservation for taxes owed by the hotel including, without limitation, sales and use tax, occupancy tax, room tax, excise tax, value-added tax, goods and services tax, and/or other similar taxes. The amount paid to the hotel in connection with a reservation for taxes may vary from the amount we estimated and charged the Customer. The amount charged also includes an amount to compensate Southwest Airlines Vacations for their services as well as covering costs incurred in connection with handling reservations.
- Southwest Airlines Vacations is not the vendor collecting and remitting taxes to the applicable taxing authorities. Our hotel suppliers, as vendors, include all applicable taxes in the amount billed to us and we pay over such amounts directly to the vendors. Southwest Airlines Vacations is not a co-vendor associated with the vendor with whom we book or reserve Customer’s travel arrangements. Taxability and the appropriate tax rate and the type of applicable taxes vary greatly by location.
- Rental Car: Rates for packages including a rental car do not include gasoline, taxes, optional insurance, Collision Damage Waiver (CDW), underaged driver charges if under the age of 25, or airport charges which are payable directly to the rental car company. Alamo and Dollar rental car drivers must be 21 years of age or older. A valid driver’s license and major credit card in driver’s name are required.
- The Pre Travel Waiver: The Pre Travel Waiver (PTW) can be purchased with a package and will waive all penalties (The Mark Travel Corporation’s and supplier’s) when travel arrangements are cancelled prior to scheduled outbound departure date and within penalty periods. PTW protects you from all cancellation penalties, but does not eliminate charges for no shows. PTW can only be purchased for all travelers booked on a reservation.
- Purchase of the PTW guarantees the lowest available package rate for the specific travel itinerary providing the claim is made at least five (5) business days prior to scheduled departure date.
- The purchase of PTW does not waive any of The Mark Travel Corporation revision fees assessed before departure date. PTW must be purchased and paid for at time of booking and is nonrefundable.
- If the number of individuals traveling decreases, the remaining travelers will be responsible for additional costs incurred as a result of a change in party size.
- Note: PTW should not be confused with other more inclusive traveler’s insurance programs. The PTW is not available on Southwest Airlines Vacations Ski or Special Event Packages.
- During Travel Protection is also available for purchase. Coverage includes trip cancellation/interruption, trip delay, medical expense, emergency evacuation, and baggage protection benefits. Please refer to the Description of Coverage for full program terms and conditions or for more information, contact the Plan Administrator at 1-800-272-2242. The During Travel Protection Plan cost is nonrefundable.
- Some package types may only offer a combination purchase of PTW and During Travel Protection.
- Southwest Airlines Vacations sells leisure vacations. Individuals attending a convention may not use this product for their hotel stay. If this vacation is used for any reason other than leisure travel, some hotels may directly assess an additional surcharge or refuse service during holiday, convention, or special event time periods.
REFUNDS FOR CANCELLATIONS AND REVISIONS
- If Customer changes travel plans, the right to a refund is limited.
- No refunds will be made for missed or unused flights or for any cancellations made less than 48 hours prior to departure date.
- All cancellations, changes to the departure date, changes in origin or destination of the package, or reduction to the number in travel party, made outside of 48 hours prior to departure date will result in a $100 per person cancellation fee plus any applicable supplier charges. Replacing a passenger’s name with the name of another traveler is considered a cancellation of the original passenger.
- Revisions to hotel, ground transportation, features, or changes to return date or flight times maintaining original departure date and original origin/destination pair made 45 to five (5) days prior to departure date will result in a $30 per reservation revision fee, any applicable hotel or other supplier charges, plus a $7.50 document delivery fee to ensure receipt of documents.
- Standard cancellation parameters and penalties outlined above may be more restrictive on holiday and specialty packages, (i.e., New Year‘s Eve). No refunds will be made for special events or other features, such as attractions or passes.
- No new bookings or revisions may be made less than five (5) days prior to departure date.
- A passenger’s request for a refund must be confirmed by sending a written request to Southwest Airlines Vacations via mail, e-mail, or fax at the time of cancellation or revision. All unused documents, especially air tickets, must be returned to Southwest Airlines Vacations prior to issuance of any refund. - Acceptance of a refund constitutes a waiver by passenger of all rights and remedies under applicable law.
RESPONSIBILITIES OF SOUTHWEST AIRLINES CO.
- Southwest Airlines Co. is responsible only for the air transportation it provides in connection with this package and is not responsible for ground transportation, accommodations, or other features of the vacation.
- All passenger air transportation via Southwest Airlines Co. shall be provided under the terms and conditions of the Contract of Carriage of Southwest Airlines Co. The Contract of Carriage is available for inspection at all Southwest Airlines airport ticket counters or online at southwest.com.
- Southwest Airlines Co. is not responsible for refunding or replacing a lost, stolen, or destroyed Southwest Airlines Co. ticket or any lost, stolen, or destroyed portion of a ticket.
RESPONSIBILITIES OF THE MARK TRAVEL CORPORATION (THE OPERATOR)
- The Operator is an independent contractor that arranges travel-related services for individual, tour, and group travel.
- The Operator is neither an agent of the Customer nor of those providing travel-related services, and does not in any manner directly provide accommodations, transportation, meals, or other travel-related services.
- The Operator shall neither be liable for personal injury or property loss or damage resulting from the acts, omissions, or negligence of any person providing accommodations, transportation, meals, or other travel-related services.
- The Operator shall not be liable for any delayed departure, missed carrier connections, substitutions of accommodations, or of common carrier equipment, termination of service, changes in fares and rates, or for cancellation or double booking of reservations or tickets beyond the Operator’s control and without the Operator’s prior notice.
- The Operator reserves the right to alter the printed itinerary or schedule of any tour or trip as may be necessary with or without notice. The Operator shall not be responsible for any inconvenience or expense occasioned by such changes.
- The Operator reserves the right to decline any Customer at any time for any reason whatsoever.
- The Operator is not responsible for the exchange or refund of any lost or stolen feature documents.
RESPONSIBILITIES OF THE PASSENGERS
- Passengers 18 years of age and older must have a valid, government-issued photo identification.
- Check in at airline ticket counter or skycap at least 90 minutes prior to scheduled departure to exchange ticket for boarding pass.
- Customers presenting themselves for checkin at the departure gate less than 10 minutes before scheduled or posted departure time will lose their confirmed reservations and will not be eligible for denied boarding compensation.
- Federal Aviation Administration mandated carryon baggage rules apply.
- When a Customer’s ticket, or a portion of his or her ticket, is lost, stolen, or destroyed, he or she will be required to purchase another ticket at the appropriate fare before transportation will be furnished between the points covered by the lost ticket. There will be no refund or replacement for a lost, stolen, or destroyed ticket.
- Claims on checked baggage are limited to $3,000 per person unless a higher value is declared and applicable charges paid.
- Unless you file any claim you may have with The Mark Travel Corporation/Southwest Airlines Vacations within 30 days after the termination of your trip, The Mark Travel Corporation/Southwest Airlines Vacations are released from all further liability.
- Tickets are flight/date specific. Passengers may not make changes in their route, city of origin or destination, or exchange or transfer their tickets to another date, another passenger, or another airline.
- Flight times are tentative and subject to change without notice.
GENERAL INFORMATION
- Neither Southwest Airlines Co. nor The Mark Travel Corporation doing business as Southwest Airlines Vacations shall be responsible for rate changes, errors, or omissions in printed or electronic material.
- Your Southwest Airlines Vacations reservation is not ticketless and tickets are required for checkin.
- Due to the special nature of vacation package air fares, tickets may only be used for travel on the ticketed itinerary. Any flight/routing changes requested by the traveler/purchaser will require the purchase of new tickets from Southwest Airlines at the applicable roundtrip fare.
- Flight times are tentative and subject to change without notice.
JURISDICTION
It is agreed by and between Passenger and Operator that all disputes and matters whatsoever arising under or in connection with or incident to the responsibilities of The Mark Travel Corporation shall be litigated, if at all, in and before a court located in the State of Wisconsin, U.S.A., to the exclusion of the courts of any other state or country. The Mark Travel Corporation, Tour Operator for Southwest Airlines Vacations, P.O. Box 1460, Milwaukee, WI 53201-1460.
CARRIER RESERVES THE RIGHT TO REFUSE CARRIAGE TO ANY PERSON WHO HAS ACQUIRED A TICKET IN VIOLATION OF APPLICABLE LAW OR CARRIER’S TARIFFS, RULES, OR REGULATIONS ISSUED BY THE CARRIER.
